Agreement to Terms

By accessing or using Holiday Cards AI ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

Description of Service

Holiday Cards AI is an AI-powered platform that generates custom holiday cards based on user input. The Service uses artificial intelligence technology to create unique, personalized greeting cards for various occasions.

Account Registration

To use the Service, you must:

• Be at least 13 years of age
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

You may not use another person's account without permission or share your account with others.

Token System and Pricing

How Tokens Work

• Each card generation costs 1 token
• New accounts receive 1 free token upon registration
• Additional tokens can be purchased through token packs
• Tokens never expire once purchased
• Tokens are non-transferable and non-refundable once used

Purchases

All token purchases are:

• One-time payments (not subscriptions)
• Processed securely through PayPal
• Final sale once tokens are added to your account
• Subject to applicable taxes in your jurisdiction

Refunds

We offer refunds for unused tokens within 30 days of purchase. Once a token is used to generate a card, it cannot be refunded. To request a refund, contact us at support@holidaycardsai.com.

User Content and Conduct

Your Responsibilities

When using the Service, you agree not to:

• Generate cards with illegal, offensive, or harmful content
• Violate any applicable laws or regulations
• Infringe on intellectual property rights of others
• Use the Service to harass, abuse, or harm others
• Attempt to circumvent token requirements or payment systems
• Reverse engineer or attempt to extract source code
• Use automated systems (bots) without permission
• Upload malicious files or viruses

Content Moderation

We reserve the right to:

• Review generated cards for compliance with these Terms
• Remove cards that violate our policies
• Suspend or terminate accounts that violate these Terms
• Report illegal content to appropriate authorities

Intellectual Property Rights

Your Generated Cards

You retain full ownership and rights to cards you generate using the Service. You may use, modify, distribute, and commercially exploit your generated cards without restriction.

Our Service

The Holiday Cards AI platform, including its design, code, algorithms, and branding, is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute our platform without explicit permission.

AI-Generated Content

Important notes about AI-generated cards:

• AI-generated content is unique but not guaranteed to be completely original
• We use third-party AI services (Claude AI, Flux AI) for generation
• Quality and accuracy may vary based on your input
• We do not guarantee specific results from your prompts
• Generated cards may occasionally contain unexpected elements

You are responsible for reviewing generated cards before use or distribution.

Service Availability

We strive to maintain high availability but do not guarantee:

• Uninterrupted access to the Service
• Error-free operation
• Immediate card generation
• Permanent storage of generated cards

We may modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.

Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "as is" without warranties of any kind
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid for tokens in the past 12 months
• We are not responsible for third-party services (AI providers, payment processors)
• We are not liable for how you use generated cards

Indemnification

You agree to indemnify and hold harmless Holiday Cards AI and its affiliates from any claims, damages, losses, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Content you generate using the Service

Privacy

Your use of the Service is also governed by our Privacy Policy. Please review it to understand how we collect, use, and protect your information.

Account Termination

By You

You may delete your account at any time through the Settings page. Upon deletion:

• Your account and personal information will be permanently deleted
• All generated cards will be removed
• Unused tokens will be forfeited
• This action cannot be undone

By Us

We may suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent activity
• Abuse the Service or other users
• Remain inactive for an extended period

Dispute Resolution

If you have a dispute with us, please contact us first at support@holidaycardsai.com to attempt to resolve it informally. If we cannot resolve the dispute, you agree to resolve it through binding arbitration rather than in court, except where prohibited by law.

Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Holiday Cards AI operates, without regard to conflict of law principles.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes by:

• Posting the updated Terms on this page
• Updating the "Last updated" date
• Sending email notifications for material changes

Your continued use of the Service after changes constitutes acceptance of the modified Terms.

Severability
